These Terms and Conditions govern your access to and use of Scraive.com. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

Service Description

Scraive provides an AI-powered creative design suite offering image editing, video editing, background removal, photo retouching, image upscaling, video enhancement, AI art generation, video generation, e-commerce graphics design, passport photo creation, meme creation, and related features (collectively, the "Service").

The Service is provided on an "as-is" basis. Features and functionality may change, be updated, or discontinued at any time at our sole discretion.

User Accounts and Registration

To use Scraive, you may need to create an account. You agree to:

•Provide accurate, current, and complete information during registration
•Maintain the confidentiality of your password and account credentials
•Accept responsibility for all activities that occur under your account
•Notify us immediately of any unauthorized access or use of your account

You must be at least 18 years old or have parental/guardian consent to use the Service.

User-Generated Content and AI-Generated Content

User-Generated Content ("UGC"):

•You retain all ownership rights to content you upload to Scraive
•By uploading content, you grant Scraive a worldwide, royalty-free, non-exclusive license to use, process, and store your content to provide the Service
•You represent and warrant that you own or have the rights to all UGC you upload, and that it does not violate any third-party rights

AI-Generated Content:

•Content generated entirely by AI (text, images, videos created using Scraive's AI generation tools) is owned by you
•You may use AI-generated content for personal, commercial, or any lawful purpose
•You agree that Scraive may use anonymized, aggregated AI-generated content for improving our models and Service (without identifying you)

Acceptable Use Policy

You agree NOT to use Scraive to:

•Create, upload, or generate content that is illegal, harmful, hateful, defamatory, obscene, or violates any law or regulation
•Infringe on intellectual property rights, including copyrighted materials, trademarks, or patents
•Create deepfakes, non-consensual intimate imagery, or content impersonating another person
•Engage in harassment, bullying, threats, or violence
•Generate misinformation, disinformation, or propaganda
•Attempt to reverse-engineer, hack, or exploit the Service's infrastructure
•Use the Service for commercial purposes without appropriate licensing (for free tier users)
•Violate or attempt to circumvent any security measures or usage limits

Violation of these policies may result in immediate account suspension or termination.

Intellectual Property Rights

Scraive owns all rights to the Service, including its software, design, functionality, and documentation. The Scraive trademarks, logos, and brand elements are our property. You may not use them without our prior written consent.

Your UGC and AI-generated content remain your property, subject to the license you grant us as described in Section 3.

Limitation of Liability

•SCRAIVE IS PROVIDED "AS-IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED
•WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL CODE
•WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE
•OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO SCRAIVE IN THE 12 MONTHS PRIOR TO THE CLAIM

Modification and Termination of Service

We reserve the right to:

•Modify, update, or discontinue any features of the Service at any time
•Suspend or terminate your account if you violate these Terms or our Acceptable Use Policy
•Change pricing or service terms with 30 days' notice

Upon termination, your right to use the Service immediately ceases. You may request the deletion of your account and associated data by contacting us.

Payment and Billing

If you purchase a paid subscription or service:

•Prices are subject to change with 30 days' notice
•All payments are non-refundable except as provided in our Refund Policy
•You authorize us to charge your payment method for all fees and charges
•Failed payment may result in suspension of your access to the Service

Data Security and Privacy

We take reasonable measures to protect your data. However, no security system is impenetrable. You acknowledge that data transmission over the internet carries inherent risks.

Indemnification

You agree to indemnify and hold harmless Scraive, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

•Your violation of these Terms
•Your use of the Service
•Your UGC or AI-generated content
•Your infringement of any third-party rights

Dispute Resolution and Governing Law

These Terms are governed by the laws of the jurisdiction where Scraive operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or negotiation, or in the courts, at the sole discretion of Scraive.
